Terms of service

TERMS OF SERVICE

Last updated: 22 October 2026

OVERVIEW

Welcome to Jump the Dark.

These Terms of Service ("Terms") govern your use of www.jumpthedark.co.uk and any associated products, content, features and services provided through our website (collectively, the "Services").

Throughout these Terms, "Jump the Dark", "we", "us" and "our" refer to the business operating this website.

Our online store is powered by Shopify, which provides the ecommerce platform through which we offer our products and services.

By using our website or placing an order, you agree to these Terms and the policies referenced within them.

Please read these Terms carefully before using our Services.

Nothing in these Terms excludes or restricts your statutory rights under applicable consumer protection legislation, including the Consumer Rights Act 2015.

1. ONLINE STORE ACCESS & ACCOUNTS

You agree to use our website lawfully and to provide accurate, complete and up-to-date information when placing orders or creating an account.

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and taking reasonable precautions to prevent unauthorised access.

You must not impersonate another person, provide fraudulent information or use our Services for unlawful purposes.

Purchases must be made by individuals legally capable of entering into a contract or with appropriate parental or guardian authorisation.

We may restrict or suspend access where we reasonably believe our Services are being misused, subject to applicable law.

2. OUR PRODUCTS

Jump the Dark is an independent clothing and lifestyle brand offering original designs, apparel and accessories.

We make reasonable efforts to ensure that product descriptions, specifications, photographs, colours and sizing information are accurate.

However, slight variations may occur due to:

  • Screen settings and colour calibration.
  • Differences in garment production and fabric characteristics.
  • Printing and manufacturing tolerances.
  • Lighting and photographic conditions.

These variations do not affect your statutory rights where goods are faulty, materially different from their description or otherwise fail to meet applicable consumer protection standards.

We may update product descriptions, introduce new designs, discontinue products or change product availability.

Any changes affecting an accepted order will be handled in accordance with applicable law.

3. ORDERS & ORDER ACCEPTANCE

When you place an order through our website, you are making an offer to purchase the selected products.

An automated order acknowledgement confirms that your order has been received but does not necessarily mean that it has been accepted.

A contract is formed when we confirm acceptance of your order, normally through a dispatch confirmation, unless we expressly confirm acceptance earlier.

We reserve the right to decline an order before acceptance for legitimate reasons, including:

  • Products being unavailable.
  • Incorrect pricing or product information.
  • Suspected fraudulent transactions.
  • Payment authorisation problems.
  • Delivery restrictions or legal requirements.

If we cannot fulfil an order for which payment has already been collected, we will arrange the appropriate refund without undue delay.

Once an order has been accepted, cancellation and changes are subject to applicable contractual and statutory rights.

4. PRICES, PAYMENTS & BILLING

All prices displayed on our website are shown in the applicable currency selected or displayed at checkout.

Prices may change without notice, but changes will not normally affect orders already accepted.

The total amount payable, including applicable delivery charges and taxes collected by us, will be displayed during checkout.

We accept the payment methods offered through our checkout, which may include debit cards, credit cards, Shopify-supported payment services, Klarna and Clearpay.

Buy-now-pay-later arrangements are subject to the relevant provider's eligibility requirements and terms.

Customers must provide accurate billing and payment information and must be authorised to use their selected payment method.

5. PRICING ERRORS & INACCURACIES

Although we take care to maintain accurate website information, occasional errors may occur.

These may include incorrect prices, product specifications, promotional details, delivery charges or stock availability.

Where a genuine error is identified before an order is accepted, we may correct the information and decline the order.

If an error is identified after acceptance, we will contact you to explain the situation and seek an appropriate resolution in accordance with applicable law.

We will not charge additional amounts without your agreement.

Where cancellation is legally permitted and payment has been collected, an appropriate refund will be issued.

6. SHIPPING & DELIVERY

Jump the Dark ships within the United Kingdom and to selected international destinations.

Shipping options, charges and available services are displayed at checkout or explained in our Shipping Policy.

Estimated delivery times are provided as guidance and are not guaranteed unless expressly agreed.

Delivery may be affected by circumstances outside our reasonable control, including postal disruption, customs processing, severe weather and other unexpected events.

We will take reasonable steps to communicate significant delays and resolve delivery problems.

For consumer purchases, responsibility for the goods generally remains with Jump the Dark until they come into the physical possession of the customer or a person identified by the customer to receive them.

Different rules may apply where a customer independently arranges a carrier not offered by us.

Nothing in this section affects your statutory rights concerning delayed, missing or undelivered goods.

For further information, please refer to our Shipping Policy.

7. INTERNATIONAL ORDERS, CUSTOMS & IMPORT CHARGES

International orders may be subject to customs declarations, import requirements, taxes, duties or other charges imposed by the destination country.

Where import duties or taxes are included in the delivery service or collected by Jump the Dark, this will be indicated where applicable.

Where such charges are not included, customers may be responsible for paying them to the relevant authorities or delivery provider.

We recommend reviewing the applicable shipping information before placing an international order.

Customs procedures and international delivery requirements may affect delivery times.

We will provide reasonable assistance with shipping enquiries and fulfil our legal obligations concerning delivery and consumer rights.

8. RETURNS, REFUNDS & CANCELLATIONS

We want customers to be satisfied with their purchases.

Our Returns & Refunds Policy explains the procedures for cancelling orders, returning unwanted items, requesting exchanges and reporting faulty or damaged products.

For eligible distance purchases, customers generally have 14 days after receiving their goods to notify us of their decision to cancel, followed by a further 14 days to return the items.

Certain genuinely personalised or custom-made products may be exempt from change-of-mind cancellation rights, where permitted by law.

Standard Jump the Dark designs are not automatically exempt simply because they are printed or prepared after an order is placed.

Faulty or incorrectly supplied products remain subject to applicable statutory consumer rights.

Please refer to our full Returns & Refunds Policy:

https://jumpthedark.co.uk/policies/refund-policy

Nothing in these Terms limits your statutory cancellation, refund, repair or replacement rights.

9. INTELLECTUAL PROPERTY & ORIGINAL DESIGNS

Unless otherwise stated, the artwork, graphics, illustrations, designs, branding, logos, written content, photography and other original materials displayed on our website are owned by Jump the Dark or used with appropriate permission or licensing.

These materials may be protected by copyright, trademark, design rights and other applicable intellectual property laws.

Purchasing a Jump the Dark product does not transfer ownership of the intellectual property associated with its design.

Without appropriate written permission, you must not:

  • Copy, reproduce or commercially exploit our original designs.
  • Reproduce our artwork on clothing, accessories or other merchandise.
  • Use our logos or branding in a way that suggests an unauthorised association with Jump the Dark.
  • Distribute or commercially republish our photographs, graphics or website content.
  • Create unauthorised commercial reproductions of our protected artwork.

You may browse our website and use its content for ordinary personal, non-commercial purposes, subject to applicable law.

Nothing in these Terms restricts uses permitted by law.

Third-party trademarks, artwork and other protected materials remain the property of their respective rights holders.

All rights not expressly granted are reserved.

10. AI-GENERATED IMAGERY & MODEL PHOTOGRAPHY

Jump the Dark may use a combination of traditional photography, photographs featuring real models and AI-generated or AI-assisted imagery.

These images may be used for product presentation, creative campaigns, editorial content and promotional purposes.

AI-generated imagery

Some promotional or model images may be created or enhanced using artificial intelligence.

Such images may depict fictional individuals or digitally modified environments.

We aim to ensure that our imagery provides a fair representation of the products being advertised.

Real model photography

Photographs featuring real individuals are used subject to applicable permissions, agreements and legal requirements.

Product representation

While AI-assisted and traditional imagery may contain minor visual differences, product descriptions and specifications are intended to accurately represent the garments and accessories offered for sale.

Where an image differs materially from the product supplied, customers retain their applicable statutory rights.

11. CELEBRITY, ARTIST & PUBLIC FIGURE IMAGERY

Our website and promotional materials may feature photographs or references involving musicians, artists, public figures or other individuals.

Such materials are used where we believe we have an appropriate legal basis, permission or licence, or where their use is otherwise lawful.

The appearance of an individual in our content does not automatically imply sponsorship, endorsement, partnership or an ongoing commercial relationship with Jump the Dark.

Any actual collaboration or endorsement will be identified appropriately.

The rights of photographers, individuals and other relevant rights holders remain respected.

If you believe any material on our website infringes your rights, please contact us with the relevant details so we can investigate.

12. COMPETITIONS, PROMOTIONS & GIVEAWAYS

From time to time, Jump the Dark may organise competitions, promotional giveaways, prize draws or other promotional activities.

Each promotion may be subject to additional terms explaining eligibility, entry requirements, opening and closing dates, prize details and winner selection.

Eligibility

Participants must satisfy the eligibility requirements stated for the relevant promotion.

Entry requirements

Entries must comply with the published instructions and applicable rules.

Winner selection

Winners will be selected using the method stated in the promotion, which may involve a random draw or assessment against published judging criteria.

Prizes

Prizes will be described in the relevant promotional terms and are not normally exchangeable for cash unless otherwise stated.

Where a prize becomes unavailable, we may offer a reasonable alternative where permitted by the promotion's terms and applicable law.

Winner notification

Winners will be contacted using the method specified for the promotion.

If a winner does not respond within the stated period, an alternative winner may be selected where the published rules permit.

Publicity

We will not assume unrestricted rights to use participants' names, photographs or other personal information merely because they enter a promotion.

Any publicity or use of submitted content will be handled in accordance with the relevant promotion rules, applicable permissions and our Privacy Policy.

Social media promotions

Unless expressly stated otherwise, promotions hosted through social media platforms are not sponsored, endorsed or administered by those platforms.

We may amend, postpone or cancel a promotion where reasonably necessary, subject to applicable law and the rights of participants.

Specific promotional terms will take precedence over this general section where appropriate.

13. CUSTOMER REVIEWS, COMMENTS & SUBMISSIONS

Customers may submit reviews, feedback, suggestions, photographs or other content through our website or associated channels.

By submitting content for publication or promotional use, you confirm that you have the necessary rights and permissions to provide it.

You grant Jump the Dark a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for the purposes for which it was submitted, including operating our website, displaying reviews and promoting our products where appropriate.

This does not transfer ownership of your original content to Jump the Dark.

We may moderate or remove submissions that are unlawful, misleading, abusive, defamatory, infringing or otherwise inappropriate.

Customers must not submit content that infringes another person's intellectual property, privacy or other legal rights.

Where personal information is involved, its processing is governed by our Privacy Policy.

14. OPTIONAL TOOLS & RETRO ARCADE

Our website may include additional features, interactive content, games or third-party tools, including the Jump the Dark Retro Arcade.

These features are provided for entertainment, convenience or general website functionality.

We may update, replace, temporarily suspend or discontinue optional features where reasonably necessary.

We do not guarantee uninterrupted availability of free entertainment features or third-party services.

Users must not attempt to interfere with games, manipulate website functionality, introduce malicious code or access restricted systems.

Where third-party tools or content are involved, additional provider terms may apply.

Nothing in this section excludes liability that cannot legally be excluded.

15. THIRD-PARTY WEBSITES & SERVICES

Our website may contain links to external websites, payment providers, social media platforms or other third-party services.

These services may operate under their own terms, conditions and privacy policies.

We do not control independent third-party websites and are not responsible for their separate content or business practices.

Customers should review the relevant terms before using external services.

This does not affect our responsibility for products and services that Jump the Dark is legally required to provide.

16. RELATIONSHIP WITH SHOPIFY

Jump the Dark operates its online store using Shopify's ecommerce platform.

Shopify provides technology and infrastructure supporting website functionality, checkout, payments and related services.

Sales contracts for Jump the Dark products are entered into with Jump the Dark, not Shopify, unless expressly stated otherwise.

Shopify may independently process certain information in connection with its platform and services.

Further information about data processing is available in our Privacy Policy and Shopify's applicable privacy documentation.

17. PRIVACY & PERSONAL INFORMATION

Our Privacy Policy explains how personal information is collected, processed, stored and shared when customers interact with Jump the Dark.

This includes information relating to purchases, payments, deliveries, returns, marketing and website activity.

Please review our Privacy Policy:

https://jumpthedark.co.uk/policies/privacy-policy

Where there is a conflict concerning the processing of personal information, the applicable Privacy Policy and mandatory data protection legislation will govern.

18. PROHIBITED WEBSITE USE

You must not use our website or Services to:

  • Engage in unlawful or fraudulent activity.
  • Infringe intellectual property rights.
  • Upload viruses, malware or other harmful code.
  • Attempt unauthorised access to website systems or customer information.
  • Harass, threaten or abuse other users or our representatives.
  • Misrepresent your identity or submit deliberately false information.
  • Conduct unauthorised scraping, automated extraction or commercial exploitation of website content.
  • Circumvent security measures or interfere with website functionality.
  • Use our Services in a manner that unlawfully harms Jump the Dark, its customers or third parties.

We may take reasonable action against misuse, including restricting access, reporting unlawful activity or pursuing available legal remedies.

19. AUTOMATED AGENTS & SOFTWARE ACCESS

Automated software, bots and AI agents must not access or interact with our Services in ways that breach these Terms or applicable law.

Automated agents must not:

  • Conceal their automated nature to bypass access restrictions.
  • Circumvent CAPTCHAs or other security measures.
  • Conduct unauthorised data extraction.
  • Interfere with website performance.
  • Access restricted information or systems.

Where automated agent access is permitted, agents must identify themselves appropriately, including through the user-agent information required by applicable published access rules.

We may apply reasonable technical restrictions to protect our website, customers and intellectual property.

These restrictions do not override applicable legal rights or permissions.

20. WEBSITE AVAILABILITY & DISCLAIMERS

We make reasonable efforts to maintain an accessible and functional website.

However, we cannot guarantee that our website, games, optional tools or other digital features will always be uninterrupted, error-free or available.

We may temporarily suspend access for maintenance, security improvements or technical reasons.

General editorial and informational content is provided for information purposes.

Nothing in this section removes or restricts statutory guarantees, contractual obligations or consumer rights relating to products purchased from Jump the Dark.

21. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of statutory consumer rights.
  • Any other liability that cannot lawfully be excluded or restricted.

We remain responsible for losses that are a foreseeable consequence of our breach of contract or failure to exercise reasonable care and skill, where required by law.

We are not responsible for losses caused by events outside our reasonable control where we have complied with our legal obligations.

Our products are generally supplied for personal use. Where legally permitted, we do not accept responsibility for business losses arising from purchases made for commercial purposes.

Any limitation of liability applies only to the extent permitted by applicable law.

22. RESPONSIBILITY FOR UNLAWFUL CONDUCT

Users are responsible for their own unlawful actions and misuse of our Services.

Where a user infringes our intellectual property, deliberately damages our systems or otherwise acts unlawfully, we may seek appropriate legal remedies.

Any claim for compensation will be subject to applicable law and must be based on recoverable loss or another lawful entitlement.

Nothing in these Terms requires consumers to compensate Jump the Dark for matters for which they are not legally responsible.

23. SUSPENSION & TERMINATION

We may suspend or restrict access to our website or optional services where reasonably necessary for security, legal compliance or serious breaches of these Terms.

Termination or restriction of website access does not automatically remove existing contractual obligations or statutory rights.

Any outstanding orders, refunds or other obligations will be handled in accordance with applicable law.

Provisions intended to survive termination, including intellectual property protections and relevant legal obligations, will continue to apply where appropriate.

24. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as ineffective to the extent necessary.

The remaining provisions will continue to apply where legally possible.

Nothing in these Terms overrides mandatory consumer protection legislation.

25. ENTIRE AGREEMENT

These Terms, together with our applicable policies and any specific terms agreed during checkout, form the contractual framework governing purchases and use of our Services.

Nothing in this section excludes liability for misrepresentation or restricts rights that cannot legally be excluded.

Failure to enforce a particular provision does not automatically prevent us from enforcing it later.

26. ASSIGNMENT

Customers may not transfer contractual rights or obligations where doing so would be unlawful or materially prejudice our legitimate interests.

We may transfer relevant business rights or obligations where legally permitted, provided that doing so does not reduce customers' statutory rights or contractual protections.

27. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

Consumers residing elsewhere in the United Kingdom or internationally may also benefit from mandatory consumer protection laws applicable in their place of residence.

Nothing in these Terms removes any right to bring proceedings before a court that has jurisdiction under applicable law.

28. ELECTRONIC COMMUNICATIONS

By placing an order or using our Services, you acknowledge that we may communicate electronically about transactions and service-related matters.

These communications may include:

  • Order confirmations.
  • Payment notifications.
  • Dispatch and delivery updates.
  • Returns and refunds.
  • Account security information.
  • Important changes affecting our Services.

Marketing communications are managed separately in accordance with our Privacy Policy and applicable marketing rules.

29. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our operations, products, website functionality or legal obligations.

Updated Terms will be published on this page with a revised date.

Material changes will be communicated where required by law.

Changes will not retrospectively remove rights or alter accepted orders in a manner prohibited by law.
